The Protection of Personal Information Act (POPIA) is South Africa's primary data privacy law. Designed to give effect to the constitutional right to privacy, it governs how both public and private organizations collect, store, share, and otherwise handle personal information.Core PurposeThe Goal: To safeguard personal information and protect individuals (data subjects) from harm like data breaches, identity theft, and unsolicited electronic communications.Application: It applies to any person or organization that processes personal information entered in a record (both automated and manual), and covers both living natural individuals and juristic entities like companies.The 8 Processing ConditionsTo be legally compliant, organizations must align their operations with eight minimum requirements:Accountability: The organization handling the data is responsible for adhering to the law.Processing Limitation: Information must be processed lawfully, transparently, and only for specific, adequate reasons.Purpose Specification: Information must be collected for a defined, specific purpose and not kept longer than necessary.Further Processing: Any further processing must be compatible with the original purpose for which it was collected.Information Quality: Organizations must take reasonable steps to ensure personal information is complete, accurate, and up to date.Openness: Data subjects must be fully aware that their information is being collected, who is collecting it, and why.Security Safeguards: Organizations must implement strict technical and organizational measures to prevent the loss, damage, or unauthorized access to data.Data Subject Participation: Individuals have the right to request access to their records, correct errors, and request the deletion or destruction of their data.Penalties and EnforcementThe act is regulated and enforced by the Information Regulator. Failure to comply can result in severe consequences:Fines & Imprisonment: Administrative fines can reach up to (text{R}10) million, and severe offenses can lead to imprisonment for up to (10) years.Civil Action: Individuals or entities can also sue a non-compliant organization for damages.
